How to Serve Legal Process Upon the Director as Agent for Foreign Insurers and Other Persons
The Director of the Idaho Department of Insurance (DOI) is the statutory agent for service of process within Idaho upon foreign (non-Idaho) insurance companies and certain other persons, such as licensed producers, located outside Idaho.
In order to accept service of process, the Director of the DOI must receive the following:
- Two copies of each document to be served on each foreign insurance company/person. (For example, a summons and a complaint).
- A $30.00 fee for each foreign company/person being served payable to the “Idaho Department of Insurance”

Upon receipt, the DOI will verify if the company or other person (e.g. a non-Idaho producer) is eligible to be served through the Director of the DOI using the DOI database. If you want to search for an eligible company, click here.
If all affairs are in order, a notice of service of process and the copy(ies) of the pleadings served will be sent by certified mail to the company or other person for whom service was received. A copy of the notice will also be mailed to the requesting party’s attorney’s office.
